According to these reports, over 8,000 students sat for the GCE Ordinary Level Examinations in these two districts Defence Spokesman Minister Keheliya Rambukwella told yesterday's media briefing on the current security situation.

"It is significant that these innocent people, aware of the reality are raising their voices in support of their own brethren trapped in Tiger clutches," Minister Rambukwella added commenting on these series of protests taking place in the Tamil community.

"Those so-called groups screaming for Human Rights must make a note of these events taking place among the civilians. These groups never protested against the LTTE terrorising people," he added.

"We doubt whether these groups ever bothered to send even a loaf of bread to these innocent people," he lamented.

"In addition, certain groups are trying to create a chaotic situation in the local political scene to undermine the military victories in the North," the Minister said.

He stated that it was pathetic to find that certain media and political groups seeking satisfaction by highlighting the losses our Security Forces' face.

This is the reason that President Mahinda Rajapaksa's Government has embarked on a campaign to defeat the scourge of terrorism that has plagued the country. There are many forces, which are placing obstacles in realizing this objective. However, the Government is determined to fulfil its commitment to eradicate terrorism, in order to safeguard the lives of civilians.

Therefore, it is important that we keep reminding ourselves constantly on occasions of this nature of the cruel hand of terrorism that has robbed Sri Lanka of thousands of innocent lives".

Free innocent Tamils or face ban - President to LTTE

President Mahinda Rajapaksa today(Dec 22) called on the LTTE that to release all innocent Tamils it is holding hostage, in bondage and using them as human shields, with the dawn of 2009, and allow them to come to the safe areas provided for them by the Government and the Security Forces.

Failure to do this would lead the Government to proscribing the LTTE with all its consequences for the terrorist organization and will ensure that 2009 is the true Year of Heroism for the troops and also see the wiping out of LTTE terrorism from the pages of history.

He said the only enemy faced by the people is the terrorism of LTTE, and that he will not agree to any ceasefire that will strengthen the LTTE in any form.

President Rajapaksa was addressing religious dignitaries, ministers, senior administrators and leading members of the private sector to thank them for the cooperation extended to the government in this year and to inform them of the progress of the military operations against the terrorism of the LTTE and state of the economy of the country. The meeting was held at the Presidential Secretariat, Colombo.

There is only one enemy in the country, and that is terrorism. The Sinhala people are not the enemies of the Tamils, as the Tamils are not the enemy of the Sinhalese. Separatism and terror is the enemy of all, be they Sinhalese, Tamils, Muslims or Buddhists; Hindus, Christians and followers of Islam. All people should come together in unity to fight the savagery of terrorism.

He told the audience that the people of the country had given him and the government the strength top fight terrorism, and bring the LTTE to the weak position it is in today; the strength to free the motherland from the grip of terror.

"I will not agree to any ceasefire that will strengthen the LTTE in any form" he said.

"The New Year 2009 will be the fourth year with the country under my leadership. There will be very decisive challenges in 2009, to face which there will be the need for the widest unity among all people. 2009 will be the year when the country will be freed from the menace of tiger terrorism. Many evil forces will conspire to prevent the victory against terrorism, but we shall overcome them all. There will be many attempts to create division, crisis and unrest in the country, all of which are targeted at helping the cause of tiger terror. Attempts will be made to create a negative public mood in the battle against terror. But, we will face the biggest challenges and obstacles to make 2009 the Year of Heroic Victory against Terrorism," the President said.

He called on all political parties and forces to unite with the government to defeat terrorism and take the country towards development. This is the message as to the NFF that voted with the government in the last budget, to the JVP that helped me in the victory in the last presidential election and to all patriotic sections within the UNP, too, who should preserve the honour and dignity of their party by joining the government in the great patriotic tasks that lay ahead.

Fuel prices

Referring top the prevailing debate on fuel prices and economic policy, President Rajapaksa said the Government had to act with responsibility, and its responsibility was to the people. The Government needed revenue to meet the demands of development and the costs of the ongoing military operations to defeat terrorism.

It was from revenue that the government earned that it was possible to give free books to schoolchildren, provide healthy services to the people, milk food to mothers and children and also carry on the necessary operations to free the country of terrorism. Any decisions on the prices of essential items had to be taken with responsibility and concern for the actual needs of the people. The needs of a mere 04 per cent of people who use petrol for cars could not supersede the needs of more than 90 % of the people who traveled by bus and train.

He said that those who petitioned the courts on the price of petrol were the same people who campaigned abroad against the extension of the GST+ relief for the country. If they had succeeded in that, all workers in the garment industry would have suffered.

President Rajapaksa said that the government always respected the orders of the courts, even when they went against some of the policies that were being implemented to combat terrorism. These orders such as the ban on searching homes at night, and issues involving High Security Zones were observed with due respect to the courts and as there were alternate policies to be followed, despite adverse consequences, some of which were tragic.

He said the government was committed to reducing prices of essentials we when they went down in the international markets, and this was clearly seen in the reduction of the prices of petrol diesel, kerosene and other fuels in the recent budget. However, as much as the government benefits from the reduction in prices of such imports one had also to be aware of the loss the country faces with the drop in prices earned by commodities exported from the country, due to the prevailing condition s in the world.

The issue of taxation and duties should not be looked at in isolation, but as a whole, taking into consideration the needs of the entire economy. There was the need to raise duties on the import of many items to help local industry and production to benefit. Speaking in lighter vein, he said some people may today seek relief in court against the 300 % duty on cigarettes and arrack, the 450% duty on whisky or the 500 % duty on imported luxury cars.

President Rajapaksa stressed that that the function of good government required proper understanding among the Legislature, the Executive and the Judiciary. The Executive should not try to grab the powers of the Legislature, and likewise the other arms of government should also not seek to grab the powers of any other. He was fully conscious of the responsibility of the government to the people, and all decisions that affect the people would be taken ion all honesty to discharge that sacred responsibility that he bore.

Heavy payloads were dropped with precision at identified LTTE positions, Air force sources said adding that the sorties were launched in support of Navy and the advancing Task Force -1 and 57 Division troops at the Wanni battlefront.

Later, the Air force jets made two successive air sorties, West and Southwest of Kilinochchi at around 2.30p.m, the Spokesperson further said.

Navy destroys LTTE Logistics Vessel carrying War-like Materials North-east of Mullaithivu

Sri Lanka Navy destroyed a medium-size LTTE logistics vessel carrying a large quantity of war like materials seventy (70) Nautical Miles North-east of Mullaithivu during the early hours today (20th December 2008). The Navy also intercepted a cluster of LTTE boats and destroyed four enemy attack craft, which were abortively attempting to support the enemy logistics vessel, in a separate confrontation off Mullaithivu.

The medium-size enemy logistics vessel had been detected by the Navy's Offshore Patrol Vessels (OPVs) on surveillance mission in deep sea around 0130 hrs and subsequently, the Navy's patrol craft were deployed to intercept and destroy the enemy logistics vessel which was approximately 30 - 40 meters in length. In the ensuing naval fire that lasted for around 30 minutes, the enemy logistics vessel was completely destroyed. It is believed that the enemy vessel was carrying a large quantity of war like materials to the LTTE since it sank engulfed in a ball of fire under the heavy naval fire.

Four more LTTE attack craft, which were fleeing after having been abortively attempted to provide support to the enemy vessel, were also intercepted and destroyed by the Navy off Mullaithivu in a separate confrontation.

Tamils not loyal to LTTE -President

As the battle for Kilinochchi enters a decisive phase, President Mahinda Rajapaksa has urged politicians concerned over the safety of Tamil civilians to "coax the LTTE to allow the civilians to move towards the safe corridor".

In an interview to the New Indian Express, he said that the LTTE "is preventing civilians from moving to safer areas."

Terming the expected fall of Kilinochchi in the near future not as a "military victory" but as the "beginning of the restorations of democratic freedoms", the President dismissed the need to wean away people from the LTTE.

"There is error in thinking that there is need to wean the people away from the LTTE. There is nothing to show that they are fully committed to the LTTE or nurtured by it," President Rajapaksa said. He was willing to concede though a "small misled minority... may be still with it." He said: "We know that the Tamil people left in Kilinochchi and Mullaitivu are held there in the thrall of LTTE's arms."

Once that power is broken, he said, the Tamil people will be free to join the democratic system. "We will be looking towards a new Spring of Development in and for the North" he said.

The President said his country took a "serious note" of the fact that an average of 500 Indian fishing vessels enter Sri Lankan waters daily.

Declaring that "the movement of smugglers" was a threat to the country's "sovereignty and security", the President pointed to a "nexus between smugglers and the LTTE and perhaps even other terrorist organisations."

On whether the arrangement with Member of Parliament V. Muralitheran and Eastern Provincial Council Chief Minister S. Chandrakanthan (both defected from the LTTE) is working out, the President said differences of opinion were common in democracy and that he hoped the two "would sort out differences in the larger interests of the people they represent."

United Kingdom recognizes right of Sri Lanka government to fight LTTE

(By: Walter Jayawardhana)

Speaking at the adjournment debate in the British House of Commons Minister of State of Foreign and Commonwealth office said the United Kingdom recognized the right of the Sri Lanka government's democratic right to fight the Liberation Tigers of Tamil Eelam(LTTE).

Condemning the activities of the LTTE on behalf of the United Kingdom, the Minister of State, Bill Rammel told the UK parliament December 18, "The LTTE has no democratic mandate to represent the Tamil population. It is reported to recruit civilians, including children, into its ranks forcibly, to extort food and money from an already impoverished people, to abduct and kill Tamil civilians who disagree with its views or methods and to break all norms of international humanitarian law by preventing civilians from leaving conflict areas, effectively holding them as a human shield. The LTTE has conducted a terrorist campaign across the whole of Sri Lanka for nearly three decades, deliberately targeting thousands of individual civilians, as well as assassinating Government figures."

He added, ":" It is important not to forget that the LTTE is a ruthless terrorist organisation, which is responsible for serious human rights abuses against civilians throughout Sri Lanka"

According to the Hansard the following are some of the excerpts from the debate:

""With great international concern about the humanitarian and human rights situation in the north of Sri Lanka, it is timely to hold a debate on that country. Like many people in Britain, the Government are deeply concerned about the worsening conflict between the Government of Sri Lanka and the Liberation Tigers of Tamil Eelam, and its impact on the welfare and human rights of Sri Lankan citizens.

"The lack of access by non-governmental organisations and the media to the conflict zone makes an objective assessment of the conflict impossible, to put it bluntly. Many alarming reports have emerged, speculating about the extent to which both parties' activities conform with international humanitarian law. Those reports need a sober and measured analysis based on the evidence available, and I will try to provide that.

Concern for civilians in Sri Lanka and the primary responsibility of the Government of Sri Lanka to protect those means that the LTTE's role in the conflict is sometimes overlooked. It is important not to forget that the LTTE is a ruthless terrorist organisation, which is responsible for serious human rights abuses against civilians throughout Sri Lanka.

The LTTE has no democratic mandate to represent the Tamil population. The LTTE has conducted a terrorist campaign across the whole of Sri Lanka for nearly three decades, deliberately targeting thousands of individual civilians, as well as assassinating Government figures.

The UK condemns those activities and recognises the Government of Sri Lanka's democratic right to fight terrorism.

Brief case carrying LTTE terrorist turned gentleman caught with bomb; bus explosion averted

The timely detection of a bomb with its detonator by an Army Sergeant in a Kurunegala bound state bus saved the lives of nearly 100 innocent passengers, including Army personnel this evening (19) at about 5.30 p.m.

The passenger bus with its full complement, started off from Maharagama and has picked up many passengers on its way just after the Army cantonment in Panagoda.

An alert Army Sergeant in the bus after entertaining doubt about the movement of a well-dressed gentleman towards the rear part of the bus with his brand new brief case in hand, has suddenly gripped on to his hands and tried to get the brief case away, but it tore off uncovering the bomb's detonator which was to be exploded at any given moment.

Passengers supported the move and managed to overpower the "brief case LTTE terrorist turned gentleman" and handed him over to Padukka Police station with the bomb and its detonator.

Had that not been the presence of mind of the Army Sergeant, many precious lives of the passengers would have been blown to pieces once the "gentleman" receives the signal.

US Ambassador Replies to Tamilnet

by Ambassador Blake

I was disappointed to read on TamilNet criticism of the US Government's programmes to help stabilise and develop Eastern Sri Lanka. Since there is no mechanism to respond to TamilNet, I thought I would use the Embassy's blog to respond to some of the incorrect assertions in the TamilNet article.

US Ambassador Robert O’ Blake

First, a Tamil National Alliance (TNA) MP asserts in the TamilNet article that Washington's purpose in our programmes for the east is to, "help Colombo make majoritarian inroads into the east." This is incorrect. We have specifically established the goal of fostering economic development, good governance and stability while preserving the existing ethnic balance in the east.

It is well known that the east is one of Sri Lanka's poorest provinces and that poverty and lack of adequate economic opportunity are principal drivers of conflict. One of the best ways to address such poverty is to establish programmes that will link new businesses in the East with the country's principal markets in the western and other parts of the country. Indeed, USAID's Connecting Regional Economies programme in the East has five goals: *

First: Support livelihood development for vulnerable populations;

Second: Promote the development of agriculture-based value chains;

Third: Ensure that groups in conflict-affected areas benefit from participation in these value chains and our other efforts;

Fourth: Implement a workforce development strategy; and finally promote a business enabling environment.

The Member of Parliament also alleges that U.S. development initiatives "take place through direct collaboration between the American agency and the ministries of Sri Lanka, sidelining the provincial council." This also is incorrect. While we of course coordinate with the Central Government as we would in any country, none of our money goes through the Central Government. Rather, it goes directly to U.S. and/or Sri Lankan organisations working in the east to implement our programmes.

Furthermore, one of the goals of our "Supporting Regional Governance" programme in the East is to improve the capacity and Governance of the Eastern Provincial Council and Local Government authorities. Specifically, this programme aims to support and facilitate increased citizen engagement in Regional and Local Government, strengthen inter-community reconciliation, and promote social equality by, for example, promoting citizen interaction with Government institutions, and strengthening the capacity of journalists and media outlets in the East.

Lastly, the MP alleges that America's programme in the east will only "add to the ethnic conflict in the island."

He says "meaningful development of the east can take place only after a substantial political solution to the Tamil national question." We agree that a political solution is necessary, but we do not agree that meaningful development can take place only after a political solution is agreed upon.

It is important to give the people of the east the opportunity now to obtain vocational training and sustainable private sector jobs. Such sustainable livelihood opportunities are an essential part of ensuring stability and development so that the Tamil, Muslim and Sinhalese communities in the East can rebuild their lives and cooperate with each other to help the East realize its potential.

Barriers for the equal education in the North

The advancing troops of Kilinochchi have reached to the Technical college for Higher education which was affiliated to the University of Jaffna built by the ministry of Education and Higher education with the aim of educational upliftment of the Tamil students in Kilinochchi, Mulathivu, and Poonarin. The technical college consisted of a well equipped auditorium, hostel, and laboratories with the extent of 100 acres which can accommodate more than 5000 students. With the great intention of giving equal education for all irrespective of ethnicity, the government has established this institute in the North. Unfortunately no any academic year could be started as the Terrorists had been using this valuable place for their military and administrative purposes till the government troops captured it.

LTTE, as a ruthless terrorist outfit has shown its vision clearly by using this precious property of the Northern students as a military camp. LTTE is known to be one of the notorious terrorist groups in the world which uses child soldiers in combat. If such educational institutes operate in this area, terrorists will definitely encounter a scarcity of soldiers and it will be a huge problem for their existence.

Education is a fundamental right for every human being but LTTE terrorists are human right violators .They have been fighting with the aim of Mono-ethnic separate home land. But purposely V.Prabhakaran destroyed the right of education of students in north and east by activating such terrible things. V. Prabhakaran expects only the war and never knows the value of the education as he never got it. Though the Sri Lankan government is trying to give equal education for all, the terrorist leader always tries avoiding his people from getting free education as his only intension is the war.

LTTE use child soldiers for the battle field and child soldiers have become the symbol as a way of continuing LTTE militarization. Security forces and government always stand surety for security of the innocent school children. According to the sources, Tamil school children in North are being trained for the battle during the school hours, and they are recruited to the dying terrorist outfit by force. They all pray for a free world without war.

Today, we can see plenty of child right organizations and we have a problem whether they are aware of this dangerous problem of child soldering which occurred in the North of Sri Lanka.

This is the time for all nations to pay attention to the reality of this common enemy that threatens the survival of society based on respect of the freedom and dignity of humans.

Trawlers off Kochi selling diesel to LTTE agents

As the war between the LTTE and the Sri Lankan Army is escalating, reports have surfaced about Indian fishing trawlers off Kochi coast making the best out of the war by selling diesel to the LTTE agents at the mid sea for exorbitant rates.

With the war assuming huge proportion, the LTTE has been left with no other choice but to aggressively scout for fuel to power their defence and supply vehicles.

An official of the coastal base station in Kochi, which undertakes patrolling up to 12 nautical miles off coast, said they had come across fishing boats fitted with additional overhead tanks filled with diesel.

"The overhead tanks, mainly used to store fresh water, had concealed compartments to carry additional quantity of diesel. Above all, the boats fill their tanks beyond the required capacity for the journey. As of now, there is no legal framework to restrict the boats from carrying additional quantity of diesel," the official said.

He said though the patrolling team had impounded various boats, they get away saying that they required more fuel to be in sea for more number of days.

"A mechanism should be in place to check the quantity of diesel consumed by the boats, other wise they will keep on illegally selling the government-subsidised diesel to third parties," he said adding that the majority of the crew in the fishing boats were from Tamil Nadu.

Confirming that there were certain reports of diesel pilferage at the mid sea by the fishermen to the LTTE, an official of the Fisheries Enforcement Department said their duty was very much confined to checking the registration of the trawlers.

"Our job is to assist the Fisheries Department and make sure that the trawlers confined to rules and regulations laid down by the Fisheries Department," he added. Fisheries Department deputy director K L Raveendran said the government provided a subsidy of Rs 1.50 per litre for diesel for the fishing boats and it was limited to a maximum of Rs 1,500 per month for a trawler.

"We have limited the subsidy to ensure that no fishing boats misuse it," he said.

However, Coast Guard (DIG) Vijay Chafekar said they had so far not received any information in this regard.

"Neither the Kerala Marines nor the Fisheries Enforcement have apprised us of the developments. We will conduct an investigation into the incident once we get the details in writing from the departments concerned."

WFP continues to dispatch food convoys to Wanni: Refutes BBC report

While refuting a BBC Sinhala service news report, intended to draw a 'hunger crisis' in the Wanni region in Sri Lanka, WFP officials issued a press release asserting the BBC report as a "regrettable statement based in the form of a personal opinion".

"Statements given by staff members do not necessarily reflect the official policy of WFP", the communiqué‚ further read.

Following is the full text of the WFP press release.

With reference to a news item carried by BBC regarding the IDP situation in the Wanni, The United Nations World Food Programme (WFP) wishes to highlight that WFP's mandate is to provide food assistance to those in need. Statements given by staff members do not necessarily reflect the official policy of WFP. On this occasion, it was regrettable that a statement in the form of a personal opinion was provided to the BBC.

WFP, in cooperation with the Government of Sri Lanka and other stakeholders, since the beginning of the food convoy operation on 2nd October, has dispatched a total of 4,120 tons of mixed food commodities to meet the food needs of an estimated 200,000 internally displaced persons in the Wanni. In addition, a total of 250 MT rice, locally procured by WFP in the Wanni is included in the overall food distribution, making the total food made available to the IDPs in the Wanni 4,370 MT. Although WFP planned to send 750 MT food weekly, delays were experienced due to some technical, administrative and weather related constraints that did not allow the full requirement to be met.

WFP is fully committed to continue the weekly dispatches of convoys to the Wanni to ensure that the IDPs needs are met and is receiving consistent support for it from all stakeholders. So far, seven food convoys have been sent to the Wanni and the 8th one is under preparation with about 750MT food.

Each household is expected to receive a monthly ration of basic food, equivalent to 1,900 kcal per person per day. To complement the basic food needs, pregnant and lactating women as well as children under 5 receive Com-Soya Blend, nutritionally based food to prevent deterioration of their nutritional status.

WFP provides food assistance to 1.1 million people composed of internally displaced, economically affected, schoolchildren and other most vulnerable people in Sri Lanka.

18 civilians flee from LTTE tyranny- Mullaittivu

18 civilians belonging to 6 families, have fled from LTTE after been held captive for months and have sought protection with security forces at Omanthai, Monday (Dec 15) at around 3.30p.m.

The group included 11 men, 3 women, 3 boys and a girl who were reportedly from Oddusudan, Keridamadu and Mannakandal localities at Mullattivu district. According to Army sources, the civilians have made the escape from LTTE for 6 days until they reached the Omanthai Entry/ Exit point in Vavuniya.

These civilians have alleged LTTE terrorists for looting the large food stocks sent as humanitarian aid for the thousands entrapped with the outfit in Wanni. "We only receive a small portion of the food sent into Wanni", the civilians were quoted as further saying.

Meanwhile, the Human Rights Watch (HRW) on Monday (Dec 15) in a 17-page report, "Trapped and Mistreated: LTTE Abuses against Civilians in the Wanni," detailed how the LTTE is brutally abusing the Tamil population in the non-liberated Wanni regions.

"The LTTE claims to be fighting for the Tamil people, but it is responsible for much of the suffering of civilians in the Wanni," said Brad Adams, Asia director for Human Rights Watch in a communiqué‚ released. "As the LTTE loses ground to advancing government forces, their treatment of the very people they say they are fighting for is getting worse", HRW further stated in the press release urging the LTTE terrorists to end its scourge of brutality.

"In the face of an ongoing government military offensive, the LTTE has increased the pressure on the civilian population under its control. Having long used a coercive pass system to prevent civilians from leaving areas it controls, the LTTE has now completely prohibited movement out of the Wanni, except for some medical emergencies. By refusing to allow displaced persons to leave for government-held territory, the group has severely restricted their access to essential humanitarian relief. Only about a thousand people have managed to flee the conflict zone since March 2008.

By refusing to allow people their basic rights to freedom of movement, the LTTE has trapped hundreds of thousands of civilians in a dangerous war zone," HRW further asserted.

'Yaldevi express' on the rails again

The Colombo-Vavuniya, Yaldevi express that was terminated at Medawachchiya from February this year will once again run to Vavuniya from today (Dec 16).

The Defence Ministry last afternoon gave clearance to the Transport Ministry to resume the service to Vavuniya.

Railway authorities however would run the train only once a day during daytime starting at Colombo Fort at 5.45 a.m. and the return trip from Vavuniya to Colombo will commence at 1 pm.

59 troops cutoff vital road stretch: Skirmishes in southern fringes of Mullaittivu

The advancing 59 Division troops who are now making effective inroads towards the LTTE's eastern coastal garrison township have reportedly taken control over a 3km vital road stretch along the Oddusudan-Mullaittivu (A-34) road following intense battles with LTTE terrorists yesterday (Dec 15).

The road stretch located southwest of Mulliyaweli village is now under military domination, as ground troops said that the blockade would deny LTTE the use of the vital supply route connecting its eastern coastal township.

According to battlefield reports, the 59 Division troops led by Brigadier Nandana Udawatte is fiercely engaging LTTE resistance as fresh fighting has shifted towards the southern outskirts of Mullaittivu. Defence observers, are also of the view that troops would make its presence felt at Mulliyaweli village sooner, which LTTE continues to function as a main terror strongpoint.

'LTTE abuses civilians in Wanni' HRW report

Forced recruitment, restrictions on movement put lives at risk - HRW

LTTE is subjecting Tamils in the Wanni to forced recruitment, abusive forced labor, and restrictions on movement that place their lives at risk, Human Rights Watch said in a report released today (Dec 15).

The 17-page report, "Trapped and Mistreated: LTTE Abuses against Civilians in the Wanni," details how the LTTE is brutally abusing the Tamil population in areas under their control.

"The LTTE claims to be fighting for the Tamil people, but it is responsible for much of the suffering of civilians in the Wanni," said Brad Adams, Asia director for Human Rights Watch. "As the LTTE loses ground to advancing government forces, their treatment of the very people they say they are fighting for is getting worse."

In the face of an ongoing government military offensive, the LTTE has increased the pressure on the civilian population under its control.

"By refusing to allow people their basic rights to freedom of movement, the LTTE has trapped hundreds of thousands of civilians in a dangerous war zone," said Adams.

"Trapped in the LTTE's iron fist, ordinary Tamils are forcibly recruited as fighters and forced to engage in dangerous labor near the front lines," said Adams.

While increased international pressure and other factors had led to a decrease in its recruitment of children, recent reports indicate that the group has stepped up child recruitment in the Wanni. LTTE cadres have urged 14- to 18-year-olds at schools to join. The group often sends 17-year-olds for military training, apparently calculating that by the time such cases are reported to protection agencies, the youths will have turned 18 and no longer be considered child soldiers.

In "Trapped and Mistreated," Human Rights Watch calls upon the LTTE to:

* Stop preventing civilians from leaving areas under its control; respect the right to freedom of movement of civilians, including the right of civilians to move to government-controlled territory for safety;

* Stop all forced recruitment into the LTTE; end all abductions and coercion;

* End all recruitment of children under the age of 18; cease the use of children in military operations; release all child combatants currently in its ranks, as well as all persons who were recruited when children but are now over the age of 18;

* Stop all abusive or unpaid forced labor, including labor it characterizes as "voluntary"; cease demanding that all families provide labor to the LTTE; stop forcing civilians to engage in labor directly related to the conduct of military operations, such as constructing trenches and bunkers;

* Provide humanitarian agencies and UN agencies safe and unhindered access to areas under the LTTE's control, and guarantee the security of all humanitarian and UN workers, including Wanni residents working as humanitarian or UN staff.

Summary of the Report

Last year they were taking the people born in 1990; now [they are taking] those born in 1991. They look at the family identity cards and take the young ones. If people of military age go into hiding, they will take younger children or the father, until they get the boys or girls they want. The LTTE no longer gives people passes to go [out of the Wanni. At the moment, only medical cases or the elderly will get an LTTE pass. Before this time, you could hand over all your assets to the LTTE and you were free to go. But now they stop everyone, saying, "We are fighting for the people, but the people have to stay with us."

Hundreds of thousands of ethnic Tamil civilians are currently trapped in intensified fighting between the Sri Lankan armed forces and the separatist Liberation Tigers of Tamil Eelam (LTTE) in the LTTE's northern stronghold, known as the Wanni. As the LTTE has lost ground to advancing government forces, civilians have been squeezed into a shrinking conflict zone. The encroaching fighting has placed their lives increasingly in danger. Many spend their day under the constant sound of nearby small-arms fire, shelling, and bombing. Because of a near total government ban on access by humanitarian agencies and the media, the suffering of the civilian population of the Wanni receives scant attention outside Sri Lanka.

This report addresses abuses committed by the LTTE against civilians during the current fighting in the Wanni. Given the sharp limitations on access to the Wanni imposed by the LTTE and the government, we do not suggest that this is a full picture of the situation there. Yet Human Rights Watch research in Sri Lanka shows that the LTTE has brutally and systematically abused the Tamil population on whose behalf they claim to fight, and that the LTTE bears a heavy responsibility for the desperate plight of the civilians in the Wanni. The LTTE, which has been fighting for an independent Tamil state-Tamil Eelam-has a deplorable human rights record. During the past 25 years it has committed innumerable murders of Sinhalese, Muslim, and Tamil civilians, political assassinations in Sri Lanka and abroad, and suicide bombings with high loss of life. The LTTE has frequently targeted civilians with bombs and remote-controlled landmines, killed perceived political opponents including many Tamil politicians, journalists, and members of rival organizations, and has forcibly recruited Tamils into its forces, many of them children. In the areas under its control, the LTTE has ruled through fear, denying basic freedoms of expression, association, assembly, and movement.

During the current fighting, abuses have again mounted. In research conducted by Human Rights Watch in Sri Lanka from October through December 2008-including 35 interviews with eyewitnesses and humanitarian aid workers working in the north-we found extensive evidence of ongoing LTTE forced recruitment of civilians, widespread use of abusive forced labor, and improper and unjustified restrictions on civilians' freedom of movement.

The LTTE continues to systematically compel young men and women, including children, to join their forces, and have dramatically increased their forced recruitment practices. The LTTE has recently gone beyond its long-standing "one person per family" forced recruitment policy in LTTE-controlled territory and now sometimes requires two or more family members to join the ranks, depending on the size of the family. Notably, after a significant decrease in reported LTTE use of child soldiers in recent years, recruitment of children under 18 may be on the increase since September 2008, particularly of 17-year-olds. LTTE militants still use schools and displaced person camps to encourage children to join their ranks.

The LTTE continues to force civilians to engage in dangerous forced labor, including the digging of trenches for its fighters and the construction of military bunkers on the frontlines. It also uses forced labor as punishment, often forcing family members of civilians who flee to perform dangerous labor near the frontlines.

By shutting down its pass system for travel, the LTTE has banned nearly all civilians from leaving areas under LTTE control (with the exception of urgent medical cases), effectively trapping several hundred thousand civilians in an increasingly hazardous conflict zone, with extremely limited humanitarian relief. The trapped civilians provide a ready pool of civilians for future forced labor and recruitment of fighters. In doing so, the LTTE is unlawfully seeking to use the presence of the large civilian population in areas under its control for military advantage.

Human Rights Watch calls on the LTTE to stop its widespread abuses against the Tamil civilian population under its control, and to respect their human rights. In particular, Human Rights Watch urges the LTTE to stop preventing civilians from leaving areas under its control, to stop forced recruitment, as well as any recruitment of children, and to bring an end to abusive forced labor. More detailed recommendations are contained at the end of this report.

The government-ordered withdrawal of the United Nations (UN) and virtually all international humanitarian agencies from the Wanni in September 2008 has drastically worsened the plight of the civilian population. The forced withdrawal has also made it more difficult to protect the rights of the Wanni population: with a greatly restricted presence on the ground, protection agencies like UNICEF have lost the ability to monitor and act on abuses committed by all parties to the conflict in the Wanni. The government's policy of detaining those who flee from the Wanni has made many civilians fearful to seek safety in government-held areas. The massive flooding caused when Cyclone Nisha struck Sri Lanka on November 25 caused 60,000-70,000 persons to lose their homes and shelters. Although the Sri Lankan government denies it, state relief efforts have been inadequate and restrictive government policies on UN and other assistance have exacerbated humanitarian suffering in the Wanni.
